The Health and Safety at Work Act of 1974 requires you to ensure, so far as is reasonably practicable, the health and safety of all employees while at work. You also have a responsibility to ensure that others are not put at risk by work-related driving activities. The Corporate Manslaughter and Corporate Homicide Act published in 2007 places a far greater responsibility on companies in general. For the first time, companies and organisations can be found guilty of corporate manslaughter as a result of serious management failures resulting in a gross breach of a duty of care. The Act, which will come into force on 6 April 2008, clarifies the criminal liabilities of companies including large organisations where serious failures in the management of health and safety result in a fatality. With a potential minefield of laws, rules and regulations governing those who drive for work, this package will aid employers and management towards building an informed and understanding workforce.  |
